OVERVIEW
This website at https://www.myowncottage.ca (the “Site”) is operated by My Own Cottage Inc. (“we,” “us,” “our”). By accessing or using the Site, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site.
These Terms apply to all visitors and users of the Site. We may update these Terms at any time by posting the revised version here, and your continued use of the Site constitutes acceptance of the changes. The “Last updated” date above shows when they were last revised.
1. THE SITE IS INFORMATIONAL — NOT AN OFFER OF SALE
The Site provides information about our prefab and modular homes, cottages, models, pricing guidance, and services. All content — including prices, model specifications, timelines, and cost estimates — is provided for general informational purposes only and does not constitute a binding offer, quote, or contract. Any actual purchase, design, or construction of a home or cottage is governed by a separate written agreement signed by you and My Own Cottage Inc., and the terms of that signed agreement prevail over anything on the Site. Prices, specifications, and availability shown on the Site are estimates and are subject to change without notice.
2. ELIGIBILITY
By using the Site, you represent that you are at least the age of majority in your province or territory of residence. The Site is intended for adults and is not directed to children.
3. ACCEPTABLE USE
You agree not to use the Site or its content for any unlawful purpose, and specifically not to: violate any applicable law or regulation; infringe our intellectual property or that of others; harass, abuse, defame, or discriminate against any person; submit false or misleading information; upload viruses or malicious code; collect or track others’ personal information; spam, phish, scrape, crawl, or harvest data; or interfere with or circumvent the security or operation of the Site. We may terminate or restrict your access to the Site for any violation of these Terms.
4. INTELLECTUAL PROPERTY
All content on the Site — including text, images, model designs, floor plans, graphics, logos, and layout — is owned by or licensed to My Own Cottage Inc. and is protected by Canadian and international intellectual property laws. You may not reproduce, copy, distribute, resell, or exploit any part of the Site without our express written permission.
5. ACCURACY OF INFORMATION
We make reasonable efforts to keep the Site accurate and current, but we do not warrant that all information is complete, accurate, or up to date. The Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability, and we reserve the right to correct these and to change or update information at any time without notice. You should not rely on the Site as the sole basis for a purchasing decision; contact us directly for current, project-specific information.
6. USER SUBMISSIONS
If you send us ideas, suggestions, plans, feedback, or other materials (“Submissions”) — whether through a form, by email, or otherwise — you agree we may use them without restriction, compensation, or obligation of confidentiality, and you confirm your Submissions do not violate any third party’s rights or contain unlawful or malicious content. (This disclaimer applies to the Site only; the warranty applicable to any home or cottage we build is set out in your separate signed construction agreement and any applicable Tarion warranty coverage.)
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, My Own Cottage Inc. and its directors, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of or inability to use the Site, even if advised of the possibility. Nothing in these Terms limits liability that cannot be excluded under applicable Ontario or Canadian law. (Liability relating to an actual build is governed by your separate signed agreement, not by these Terms.)
10. INDEMNIFICATION
You agree to indemnify and hold harmless My Own Cottage Inc. and its directors, officers, employees, and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right.
11. SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and severed from the rest, and the remaining provisions will stay in full effect.
12. TERMINATION
These Terms remain in effect while you use the Site. We may terminate or suspend your access at any time for any violation of these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
13. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and us regarding your use of the Site. Our failure to enforce any provision is not a waiver of it.
14. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Ontario.
